The notary can be held liable for superficial checks during the process of buying property

With judgement No 22398 from October 27, 2011 the Court of Cassation has ruled that in case of the purchase of a property the notary is obliged to carefully check the cadastral map excerpts of the property. If it will be later established that the property is encumbered with a mortgage and the notary has failed to communicate this fact, the buyer is entitled to hold the notary liable for any damage caused by this.
