The (flat) roof of an apartment house – which often is used as a roof terrace – can either be part of the common property of the structure and thus can be equally used by all residents, or it is private property and thus access is given only to certain residents of the apartment house.
If the latter is the case, difficulties can easily arise concerning who is responsible to pay necessary repairs. Even though the roof terrace is private property, at the same time it is the roof of an apartment house, and as thus presents the common property of all residents.
The Italian law has explicitly stipulated the following regulation for such a case: If the repairs involve the terrace in its function as roof, 1/3 of the costs are paid by the owner and 2/3 by the remaining residents. All other repairs of the terrace have to be completely covered by the owner of the terrace.
